El alto tribunal toma esta decisi\u00f3n tras el recurso presentado contra la normativa por el Gobierno de Espa\u00f1a, que considera que el precepto vulnera competencias exclusivas del Estado y <strong>trata de dar amparo legal a actividades tipificadas en el C\u00f3digo Penal<\/strong>.<\/p>\n<p>Una providencia del Constitucional admiti\u00f3 el recurso del Ejecutivo y suspendi\u00f3 la norma hasta que el tribunal resuelva el escrito, que seg\u00fan el Gobierno contraviene competencias de normativa penal as\u00ed como las bases y coordinaci\u00f3n general de la sanidad y la <strong>legislaci\u00f3n sobre los productos farmac\u00e9uticos<\/strong>, la seguridad p\u00fablica y las relaciones internacionales, dado que afecta a convenios internacionales suscritos por Espa\u00f1a.<\/p>\n<p>Seg\u00fan el Ejecutivo, la norma que aprob\u00f3 el Parlamento de Catalu\u00f1a no es constitucional porque no puede ampararse ni en el derecho de asociaci\u00f3n, ni en el de protecci\u00f3n de los consumidores ni en el de protecci\u00f3n de la salud.
